Conditions & Restrictions Conditions & Restrictions
The following Conditions or Restrictions may be varied or amended from time to time at the discretion of Sarawak Timber Industry Development Corporation (STIDC).

1.0

REGISTRATION (GENERAL REQUIREMENT)


1.1
The Certificate of Registration is not transferable.

1.2
Registration which has expired may be reinstated and renewed upon payment of a late registration fee as follows:-


  • First contravention - As stipulated in Appendix 1 as attached.
  • Second and Subsequent contravention – Twice the amount of late registration fee as stipulated in Appendix 1 as attached

1.3
Involvement in illegal timber activities would render the registration to be cancelled.


2.0

SUBMISSION OF REPORTS/RETURNS/INFORMATION


2.1
To submit to Sarawak Timber Industry Development Corporation any statistics and information on industrial returns, export of logs and other timber products as may be required by STIDC.



3.0

MILL OPERATIONS


3.1
Mill layout plan shall be submitted to STIDC for mill registration approval.

3.2
No machinery shall be added to the mill and no structural changes be made without written approval from STIDC.

3.3
The operation of the mill/factory/plant and all its auxiliary equipment must comply with the requirements and regulations of the Department of Occupational Health and Safety, the Department of Health, Labour Department, the Department of Environment, and the local authorities.

3.4
Sawdust and other wastes shall not be thrown into river or public drain or deposited on the road verge or any public place, but may be disposed off by burning in an efficient burner/incinerator or by any other method approved in writing by the relevant authorities.



4.0

IMPORT AND EXPORT ACTIVITIES


4.1
Export and Import License


4.1.1
To obtain approved license for export and import of timber and timber products from STIDC.




4.2
Submission of Copy of Customs Declaration Forms


4.2.1
To submit a copy of Customs Declaration Form 3 (Movement of goods within the Federation) to STIDC for each shipment of timber or timber products exported from/imported into Sarawak or shipped to/or from Sabah and Peninsular Malaysia after clearance by the Customs Department.




4.3
Import of Logs and Flitches


4.3.1
To obtain prior approval from the Ministry of Planning and Resource Management Sarawak (MRPM), for importation of logs and flitches



4.4
Import of Plywood


4.4.1
To prohibit the importation of ordinary plywood.



4.5
Import of Timber and Timber Products from Indonesia


4.5.1
To be supported with relevant documents (i.e Pemberitahuan Expor Barangan (PEB), Pengakuan Sebagai Eksportir Terdaftar Produksi Industri Kehutanan (ETPIK), Surat Keterangan Sah Hasil Hutan (SKSHH) or Nota Perusahaan , Endorsement BRIK dan Laporan Surveyor issued by relevant authorities in West Kalimantan,Indonesia (timber only).


4.5.2
To import only through Harwood Timber Sdn Bhd’s timber depots at any of the State’s authorized entry and landing points at Sematan, Biawak, Tebedu, Batu Lintang and Lubok Antu.


4.5.3
To obtain prior approval from the State Government of Sarawak for the importation of sawn timber through Lubok Antu.


4.5.4
To use Malaysian registered vehicles or vessels to transport imported timber and timber products from the prescribed places within Sarawak.


4.5.5
To refrain from importing Large Scantlings and Squares of Cross Sectional sizes of 60 square inches and above (375 square centimeters and above)(for sawn timber only).


4.5.6
To obtain from STIDC for the sawn timber to be hammer marked with STIDC identification markings upon arrival at the authorized entry points.


4.5.7
To obtain from STIDC for Removal Pass and Identification Tags prior to its removal from any of the authorized entry points(for sawn timber only).


4.5.8
4.5.8 To comply with the stipulations contained in STIDC Removal Pass(for sawn timber only).


4.5.9
To ensure that the vehicle or vessel transporting sawn timber is accompanied by Removal Pass throughout the journey from any of the authorized entry points to the destinations as stipulated in the Removal Pass.


4.5.10
To surrender the Removal Pass not later than seven (7) days after the date of expiry to STIDC’s office nearest to the destination as stipulated in the Removal Pass(for sawn timber only).


4.5.11
To process Hewn Timber imported through the authorized entry point of Sematan and Biawak by mills operating within the sub-district of Sematan and Biawak.

4.6
Export and Import of Timber and Timber Products


4.6.1
To obtain prior approval from STIDC for exportation of wood residues (HS Code:4401.30000).

In addition to the interpretation of wood residues under Regulation 2 of Sarawak Timber Industry (Registration) Regulations, 2008, wood residues is also define as wood of any shapes, sizes of all species and for all kind of conditions which includes wood slabs, off-cuts, log ends, center core, rejected veneers, plywood trimmings, sawdust, wood particles, wood wool and woodchips.




4.7
Export and Import of Woodchip and Pulp


4.7.1
Exporter
 
To provide proof of supply of raw materials from registered manufacturer of woodchip who owned a Licensed Planted Forests.


4.7.2
Importer
 
To obtain prior approval from Ministry of Planning and Resource Management



5.0

Licence / Permit for Restricted Species


5.1
To obtain permit from Director of Forests, Sarawak for export of restricted timber species such as Ramin, Belian, Bakau, Sepetir, Bintangor and other species specified from time to time.




5.2
To obtain license from the Controller of Wildlife, Sarawak for collecting, cultivating, selling, exporting and importing of Gaharu.



6.0

Timber Trading


6.1
Grading Certificate


To obtain Grading Certificate from STIDC for export of sawn timber except Ramin in accordance with the Timber Grading Regulations, 2008.




6.2
Exemption from Grading Certificate


To obtain Grading Exemption Certificate from STIDC for the exportation of Ramin Sawn timber.




6.3
Convention on International Trade of Endangered Species of Wild Flora and Fauna (CITES)


6.3.1
To obtain CITES Certificate from the Forests Department, Sarawak for export of Ramin and Gaharu .


7.0

Upliftment On Prohibition For Importation Of Ordinary Plywood


The prohibition for importation of ordinary plywood with thickness 6mm and below shall be uplifted with effect from 1st July 2015 subject to the following conditions:

7.2 Exemption It has to be processed as value added products
